3. Customer Responsibilities

Customers are responsible for:

• Using only licensed and legal software
• Maintaining backups of website data
• Ensuring website content complies with applicable laws

Customers must not misuse server resources or engage in activities that negatively affect other users.

4. Acceptable Use Policy

Our services must be used only for lawful purposes. The following activities are strictly prohibited:

• Illegal websites or activities
• Phishing, malware, hacking, or exploit tools
• Spam or bulk unsolicited emails
• Cryptocurrency mining
• Torrenting or file-sharing services
• Adult or pornographic content

Violation may result in immediate account suspension, permanent termination, administrative penalties, or reporting to relevant authorities. Email delivery to inboxes cannot be guaranteed due to external email provider policies.

6. Domain Registration Policy

• Domain registration fees are non-refundable.
• Customers are responsible for renewing domains before expiry.
• makemywebhost.com is not responsible for domain expiry due to delayed renewal.
• Trademark-infringing domain registrations are strictly prohibited, including fake brand-related domains, trademark imitation domains, and misleading or fraudulent domain registrations.

7. Hosting Resource Usage

Shared hosting accounts are intended for normal website usage only. The following usage is prohibited:

• Excessive CPU or memory consumption
• Long-running database queries
• Backup storage usage
• File storage unrelated to websites
• Hosting large media archives

We reserve the right to restrict excessive resource usage, suspend accounts impacting server performance, or recommend upgrades to VPS or dedicated hosting.

8. Unlimited Hosting Policy

"Unlimited" features are subject to fair usage policies. Unlimited hosting does NOT mean unlimited server resources, unlimited CPU usage, unlimited storage for backups or media archives, or unrestricted high-resource applications.

Shared hosting services are designed for personal websites, startups, small businesses, and standard business websites. Accounts exceeding reasonable usage limits may be restricted or upgraded.

9. Backup Policy

Customers are fully responsible for maintaining backups of their data. While we may perform periodic backups, we do not guarantee backup availability, backup integrity, or complete data restoration.

Customers should always maintain independent backups of website files, databases, emails, and important data.

10. Billing & Payments

• Services are activated after successful payment confirmation.
• Prices displayed on the website are exclusive of applicable taxes unless stated otherwise.
• GST and applicable taxes will be added during checkout.

Late payments may result in service suspension, late fees, or permanent termination. Accounts with unpaid invoices may be suspended without prior notice.

11. Refund Policy

Refund eligibility depends on the service purchased. Non-refundable services include domain registrations and renewals, SSL certificates, paid licenses and software, and custom development services.

Refunds will not be issued for policy violations, spam or abuse-related suspensions, illegal activities, or excessive resource misuse. Applicable processing fees, taxes, and domain charges may be deducted from refunds.

12. Cancellation Policy

Customers may request cancellation through the client area. Customers must backup all data before cancellation. Cancelled or terminated accounts may be permanently deleted, and data recovery after deletion may not be possible.

Services may also be terminated for policy violations, fraud, chargebacks, or abusive activities.

13. Uptime & Service Availability

We strive to maintain high service availability and uptime. However, uptime guarantees do not apply to scheduled maintenance, third-party service failures, network interruptions, force majeure events, or circumstances beyond our control.

14. Security Policy

Customers are responsible for maintaining secure passwords, securing scripts and applications, updating software regularly, and preventing unauthorized access. Accounts found compromised may be suspended until security issues are resolved.

15. Limitation of Liability

makemywebhost.com shall not be liable for data loss, downtime, business interruption, revenue loss, indirect damages, or third-party service failures. Our total liability shall not exceed the amount paid by the customer for the affected service.

16. Jurisdiction & Legal Disputes

All disputes shall be subject to the jurisdiction of Gaya, Bihar, India. These Terms & Conditions shall be governed by the laws of India.

17. Changes to Terms

makemywebhost.com reserves the right to modify these Terms & Conditions at any time without prior notice. Continued use of our services after changes are published constitutes acceptance of the updated Terms.
